Who Pays Your Medical Bills After a Texas Car Wreck?

Texas is an at-fault state. The driver who caused the crash, through his or her liability insurance, is responsible for your damages. Texas requires drivers to carry at least $30,000 per person and $60,000 per crash for injuries, plus $25,000 for property damage. That is often not enough when someone is badly hurt.

Your own policy may help too:

  • Personal Injury Protection (PIP): Texas insurers must include at least $2,500 in PIP unless you rejected it in writing. PIP pays medical bills and lost wages no matter who was at fault.
  • Uninsured/Underinsured Motorist (UM/UIM) coverage: pays when the at-fault driver has no insurance, not enough insurance, or drove away.

What to Do After a Car Accident

  1. Call 911 and get medical care, even if you feel fine.
  2. Take photos of the vehicles, the road, traffic signals and your injuries.
  3. Get the other driver's name, insurance and plate number, and witness contact information.
  4. Get the crash report. Texas crash reports are usually available from TxDOT within about 10 days.
  5. Do not give a recorded statement to the other driver's insurance company.
  6. Call a lawyer before you sign anything or accept a settlement.

How Much Time Do You Have?

In most Texas car accident cases, you have two years from the date of the crash to file a lawsuit. If a government vehicle was involved, written notice is often required within six months, and some cities require notice sooner. Evidence such as video footage and vehicle data can disappear in days, so it pays to call early.

What If the Insurance Company Says It Was Partly Your Fault?

Under Texas law, you can still recover if you were not more than 50% at fault. Your recovery is reduced by your percentage of fault. Adjusters often blame the injured driver to cut the value of a claim. We collect the crash report, photos, witness statements and vehicle data to show what really happened.
