What You Need to Prove in Texas

- That failure caused your injury.
Proving the owner knew or should have known about the hazard is often the hardest part. Security video, incident reports, maintenance logs and witness statements can make the difference, and stores often keep video only for a short time.
What To Do After a Fall
- Report the fall to the manager and ask for an incident report.
- Take photos of the hazard, the area and your shoes.
- Get names and phone numbers of witnesses and employees.
- Get medical care right away.
- Do not give a recorded statement to the store's insurance company.
Deadlines
Most Texas premises liability lawsuits must be filed within two years. If you were hurt on city, county, school or state property, written notice may be required within six months or less.
