If you were hurt because someone else was careless, you should not have to fight the insurance company alone. Attorney Oscar Longoria has represented injured people and families across Hidalgo and Starr Counties since 2007 from his office in Mission, Texas. Your first consultation is free, you pay no attorney's fee unless we recover for you, and we speak English and Spanish.
Personal Injury Cases We Handle
- Car accidents on Expressway 83, Shary Road, Military Highway and Valley streets
- 18-wheeler and commercial truck crashes, including bridge, produce and oilfield trucks
- Motorcycle, bicycle and pedestrian accidents
- Workplace injuries, including claims against non-subscriber employers
- Slip and fall and other premises injuries at stores, apartments and businesses
- Wrongful death claims for families who lost a loved one
What to Do After an Accident
- Get medical care right away, even if you feel fine. Some injuries show up days later.
- Call the police and get the crash report number.
- Take photos of the vehicles, the scene and your injuries.
- Get names and phone numbers of witnesses.
- Do not give a recorded statement to the other side's insurance company before you talk to a lawyer.
- Keep every bill, receipt and record of missed work.
Texas Deadlines You Need to Know
In most Texas injury cases, you have two years from the date of the injury to file a lawsuit. If you miss that deadline, you can lose your claim for good.
Claims against a city, county or the State of Texas are different. The Texas Tort Claims Act generally requires written notice within six months, and some cities require notice even sooner. If a government vehicle or property was involved, call us right away.
What If I Was Partly at Fault?
Texas uses a rule called proportionate responsibility. You can still recover as long as you are not more than 50% at fault, but your recovery is reduced by your share of the blame. Insurance adjusters often try to push more of the fault onto you. We gather the evidence to push back.
What You May Be Able to Recover
- Medical bills, past and future
- Lost wages and lost earning capacity
- Pain and suffering and mental anguish
- Physical impairment and disfigurement
- Property damage
How We Get Paid
We handle personal injury cases on a contingency fee. You pay no attorney's fee unless we recover money for you. Depending on your fee agreement, you may still be responsible for court costs and case expenses. We will explain all of this in writing before you sign anything.
